Virginia License Suspension


In today's society, it is almost impossible to survive without a car. If you can't get to work, you can't make money, and without money you can’t afford a place to stay or food to eat.

In the Commonwealth of Virginia, you will automatically lose your license if you are arrested for driving under the influence (DUI). If you have been arrested and you want to fight this license suspension, you must immediately contact a law firm that specializes in impaired-driving cases.

Virginia law requires a seven day suspension for drivers over the age of 21 who fail a breath test with a blood alcohol content (BAC) of .08 percent or higher. If the driver is under the age of 21, the legal limit is .02 percent.

Even refusing to take the breath test will result in an automatic license suspension. This is due to implied consent. When you signed the papers to receive your driver's license, you agreed that you would comply with an officer's requests during a traffic stop. Failure to do so results in a suspension of your driving privileges. Again, this suspension will last for seven days.

If convicted of DUI, your license will be suspended by the judge, often for a longer time period. This is based upon your previous record.

Some people think that if they received their DUI in another state, it will not come back to haunt them at home. This is not so! Most states have agreements with each other that make it hard to escape the consequences of a DUI charge.

The first is the Interstate Driver's License Compact. There are 45 states that participate in this compact. Under this agreement, if a driver gets convicted of a DUI offense in a different state, his or her home state will be notified. The driver's license will be suspended or revoked until it is reinstated in the state in which the penalty occurred.

The second agreement, in which 44 states participate, is the Non-Resident Violator Compact. Under this agreement, a driver who has not take care of his or her traffic-related fines and penalties in another state can have his or her license taken away until they are taken care of.
